These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and INSPIRE Mind & Body Wellness, LLC, doing business as INSPIRE Mind & Body Wellness ("Company," "we," "us," or "our"), concerning your access to and use of our website http://www.inspirembw.com, our text messaging (SMS) program, and any other services we offer (collectively, the "Services").
You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

INSPIRE Mind & Body Wellness, LLC provides wellness, mind and body, and related services described on our website and through our booking and communication channels. The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation.
3. INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Services are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Services (collectively, the "Content"), and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws. 5. TEXT MESSAGING (SMS) PROGRAM TERMS
In Short: By opting in, you agree to receive appointment and promotional text messages from us. Message and data rates may apply. Reply STOP to cancel at any time. Carriers are not liable for delayed or undelivered messages.
5.1 Description of the SMS Program and Messaging Use Cases
By providing your mobile phone number to INSPIRE Mind & Body Wellness, LLC and opting in, you consent to receive text messages (SMS/MMS) from us and on our behalf, including:
● Transactional/operational messages — appointment confirmations, reminders, reschedule and cancellation notices, and other scheduling-related communications; and
● Promotional and marketing messages — special offers, discounts, new service announcements, seasonal promotions, wellness tips, and event or newsletter-style updates.
Consent to receive promotional or marketing text messages is not required as a condition of purchasing any goods or services from us.
5.2 Message Frequency and Fees
Message frequency varies based on your interactions with us and your communication preferences. Message and data rates may apply to any text message we send you, depending on your mobile carrier and plan. You are solely responsible for any such charges.
5.3 How to Opt Out
You may opt out of the text messaging program at any time. To stop receiving text messages from us, simply reply "STOP" to any text message you receive from us. Upon doing so, we will send you a one-time confirmation message that you have been unsubscribed, and you will no longer receive text messages from us unless you opt in again.

5.5 Carrier Liability Disclaimer
Carriers, including but not limited to wireless carriers transmitting messages on our behalf, are not liable for delayed or undelivered messages. We are not liable for any delays or failures in the receipt of any text messages, as delivery is subject to effective transmission from your network operator/wireless carrier. Not all mobile devices or carriers may support the features described in these Terms.
5.6 No Sharing of Opt-In Data
Consistent with our Privacy Policy, we do not sell, rent, lease, disclose, or otherwise share your mobile phone number or SMS opt-in consent with any third party or affiliate for their own marketing or promotional purposes.

Your use of our text messaging program, and any personal information collected in connection with it, is also governed by our Privacy Policy, which explains what information we collect, how we use it, and your rights, including how to review, update, or delete your information. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES’ CONTENT.
10. LIMITATION OF LIABILITY
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, INCLUDING THE TEXT MESSAGING PROGRAM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand made by any third party due to or arising out of your use of the Services or breach of these Terms.
12. TERM AND TERMINATION
These Terms shall remain in full force and effect while you use the Services. We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Services to any person for any reason, including breach of any representation, warranty, or covenant contained in these Terms.
13. GOVERNING LAW
These Terms shall be governed by and defined following the laws of the State of Arizona, without regard to its conflict of law provisions. INSPIRE Mind & Body Wellness, LLC and yourself irrevocably consent that the courts of Arizona shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Terms.
